PM rejects 'no confidence' session

Prime Minister Abdullah Ahmad Badawi today rejected a call by Opposition Leader Anwar Ibrahim for am emergency Parliament session to debate a no-confidence motion.

"I don't see the need as the Parliament will seat after Ramadhan," Abdullah told reporters after chairing an Umno supreme council meeting at Putra World Trade Centre today.

The Parliament is set to resume its sittings on Oct 13.

Earlier today, Anwar said he had sent a letter to Abdullah asking him to convene an emergency session of Parliament to debate a motion of no confidence against his leadership.

"I have made a formal request to call for an emergency session in Parliament to deliberate a motion of censure against the leadership of Abdullah no later than Sept 23," he had said.

Abdullah also said that he had no plans to use the Internal Security Act "against Anwar or anyone else".

The premier has been under tremendous pressure recently from Anwar who had said that he had sufficient number defectors from Barisan Nasional to form a government.

The next step would likely see Anwar going to the King but I hope with the latest reply from the PM, the King will instead send for Anwar.

RAJA PETRA’S DETERIORATING HEALTH

Aliran is seriously concerned over the deteriorating health of Raja Petra. According to his wife, Marina Lee Abdullah, “he does not look good and healthy at all”.

The deteriorating health of Raja Petra is totally due to the callous treatment of him by the police, who have completely ignored the universal norms that a detainee is entitled to.

“He has been denied sleep and is being put through mental torture,” said his wife after visiting Raja Petra.

By her account, Raja Petra had been harassed psychologically in police custody. This stress under extreme custodial conditions has caused Raja Petra to lose weight and he is feeling weak. This is a cause for concern as he is suffering from a heart ailment.

“He spoke very softly and looked weak, pale and tremendously thin,” Marina told reporters. She attributed this to the fact that Raja Petra was suffering from a lack of sleep because the previous night, he was harassed hourly by officers who recorded statements from him.

Marina has every right to be worried over his health because “her husband suffers from heart artery blockages and is on medication”. At this point in time nobody can confirm if Raja Petra is taking his medication or whether he is being monitored by a doctor.

What he is being subjected to is absolutely unacceptable and uncalled for. What makes it worse is the fact that Raja Petra’s human rights are being violated with impunity by a country that sits as a member on the United Nations Human Rights Council that is tasked with protecting and preserving human rights. It makes a mockery of our position on this Council and renders it untenable.

Raja Petra has been arbitrarily arrested, subjected to cruel, inhuman and degrading treatment, and denied a fair and public hearing by an independent and impartial tribunal in determining his guilt. He has not been recognised as a person before the law and has been denied his right to freedom of thought and conscience. All these are serious violations which must be thoroughly condemned. This cannot be condoned especially when the perpetrator is a member of the Human Rights Council.

Aliran calls upon the Malaysian government to stop its violation of the Universal Declaration of Human Rights, to release Raja Petra immediately and to live up to its obligations as a member of the United Nations.

Malaysians no longer believe that the Barisan Nasional has acted honourably, objectively and sincerely in the national interests of Malaysia in detaining Raja Petra, Teresa Kok, the Hindraf Five and all the others under the unjust ISA.

Wow... I don't know which one I find more amazing... that he replied or that he did so within 30 minutes.

Compare that to what I've been going thru with my MP and Assemblyperson.

My MP has his own blog, to which I posted a comment, protesting the arrest and use of ISA on Saturday and till today my post is still under moderation Mind you, I was polite and respectful. Looks like my view is not liked. Hmmp! Some representative of mine!

As for my Assemblyperson, I could not find any contact info. So I wrote in to his party asking for contact details. Till today, I've not received a reply. Btw both my MP and assemblyperson belong to the rulling party while Tony belongs to the Opposition and is not my MP.

Such a difference in experience.

News just out:

Teresa Kok has been released from ISA detention

I'm not sure if she will be up to it but there has been mention of a press conference by her at 3 pm.

That leaves Raja Petra. He was the first arrested and the hardest one to get out. Maybe because he was the first to report on a number of wrong doings by this goverment with proof that they want to shut him up or find out who his deep throats are. I hope he will be released soon

Teresa Kok released from ISA detention


PETALING JAYA (Sept 19, 2008) :

Member of Parliament for Seputeh Teresa Kok, who is also Selangor senior state exco in charge of investments, has been released from detention under the Internal Security Act, a week after she was taken in for her alleged role in a matter involving the azan (Muslim call to prayer).

The DAP national organising secretary was released at the Jalan Travers police station here at about 1.30 pm. Her parents, father Kok Kim Tong and mother Poh Seh Kwon, and her lawyer N. Sankara Nair were at the police station when she was released.

"I am happy that I have been released and I'm OK," she told reporters gathered at the police station. To a question, Kok said: "I do not know why I was released today, just as I do not know why I was detained."

Kok was picked up in front of her apartment in OUG Heights in Jalan Klang Lama at 11.15 pm last Friday while returning home from a function. She had been accused of petitioning a mosque to reduce the volume for the "azan" call for prayer. She has denied doing so.

A press conference has been called for 3.30pm at the DAP headquarters in Taman Paramount here for her to recount her ordeal of being confined to a 6ft by 8ft cell, during which she was allowed one visit from her parents, her favourite niece and her aide Mandy Ooi on Monday.

Her incarceration sparked a nationwide signature campaign seeking her freedom, as well as prayer sessions.

The joy of being released was clearly demonstrated in her Facebook entry at 1.35pm: "Teresa sings 'Honey, I'm home, I've had a hard day, pour me a cold one da da da....". Her sense of humour had not deserted her.

It is learnt the 44-year-old politician made the posting at the Jalan Travers police station while her release papers were being processed.

The posting was done about half an hour after she had called DAP parliamentary leader Lim Kit Siang to inform him of her release. Lim, who was then having lunch in Ipoh, said in his blog that he had at first thought that somebody was using her phone as her name had flashed on his handphone's caller identification screen.

"But it was her on the line and I wondered how she wangled the use of her phone while in detention. But no, she did no such improper thing. She told me that she was being released. Bravo. The irresistible pressures against her unjust and undemocratic detention had succeeded."

Lim said although they are jubilant, they must also be mindful that the recent spate of ISA arrests demonstrated that this iniquitous law must go. He mentioned Sin Chew reporter Tan Hoon Cheng’s 18-hour ISA detention and Teresa’s detention as testimony.

He again called for Raja Petra Kamaruddin, the editor of Malaysia Today news website, to be released immediately, as well as the Hindraf Five and all other ISA detainees.

Before her detention, Kok, a three-term MP, was linked to attempts to petition a mosque to reduce the volume for azan (the call to prayer). She has vehemently denied this and the Masjid Kota Damansara has also clarified that a damaged amplified had resulted in the calls to prayers to be made without the aid of a PA system.

The accusation surfaced in a Sept 10 article in Utusan Malaysia quoting former Selangor Mentri Besar Datuk Seri Dr Mohd Khir Toyo. Kok's name was not mentioned in that article.

Kok also lodged a police report against Utusan Malaysia, its columnist Zaini Hassan and Dr Mohd Khir.

On Monday, Kok filed a habeas corpus application in the High Court for her release.

Could not update yesterday night as we had an electrical blackout. So instead went to sleep early and was up at 5am without the help of the alarm clock!

Nothing seemed to have happened over night, at least so far nothing in the news.

From the various articles and news reports that I have read, I would like to describe the cell of an ISA detainee.

The cell is 6x8 feet. The walls do not have any windows. There is one artificial light. All sense of time is lost here, the person won't know what day it is.

As for the bed, I'm not sure as I've read different things in different articles hence I'm not going into that yet. If I can find something more definitive on it, I will post it up.

My ISA detention is without any legal or moral basis. It is a clear abuse of detention without trial.

I have been released after being detained in solitary confinement in a 6ft by 8ft holding cell for seven days under the Internal Security Act. I was informed by the police that they detained me under Section 73(1) of Internal Security Act 1960, which means I have incited racial and religious tension and conflict.

After being detained for seven days under the guise of so-called investigations, the police failed to produce any evidence or proof of me being involved in the activities of causing racial and religious tension.

They were only able to ask me few questions based entirely on the false and malicious article written by Zaini Hassan under the topic “Azan, jawi, JAIS, Uitm dan ba-alif-ba-ya” that was published in Utusan Malaysia on Sept 10, 2008.

The three main questions that the investigation officers asked me were:

1) Whether I had mobilised a group of residents at Bandar Kinrara to present a petition to oppose to the azan at the Bandar Kinrara mosque;

2) Whether I had made a statement that 30% of the Selangor Islamic Department (JAIS) allocation is to be given to other non-Islam religious bodies; and

3) Whether I had opposed the Jawi wording in road signages in Kuala Lumpur.

I denied the first two accusations as I did not do any such things as accused. I also told them that the issue of opposing Jawi road signages in Kuala Lumpur was done in January/ February 2008 at the request and following the pressure of resident associations. The resident associations, particularly in Taman Seputeh, were most unhappy because many of the road signages were changed arbitrarily by DBKL a few months before and changed again soon after this time with Jawi wordings. They were strongly opposed to this kind of wastage of public funds by DBKL.

I was quite surprised that there were no other questions posed to me besides these few main questions.

The Internal Security Act is meant to detain people who threaten national security. The three issues stated above have nothing to do with national security. If the police wanted to carry out investigations on me, they can always ask me to give statements in any police station and there was absolutely no need to detain me under the ISA for seven days. This is a phenomenal abuse of the power of police under the ISA.

Besides, it is nonsensical for the police to detain me under the ISA merely based on the unsubstantiated article written by an irresponsible columnist in Utusan Malaysia. How can they regard that article as the gospel truth without investigating the writer in the first place? How can Utusan Malaysia publish it without verifying the facts?

I wish to ask the police whether they have called Zaini Hassan and Utusan Malaysia’s editors for questioning before and after my detention.

I know that the imam of Bandar Kinrara mosque has publicly denied that I got involved in the Puchong residents petition against the azan of his mosque on Sept 13. I am also quite surprised to read in the New Straits Times dated Sept 19 that the official of the Bandar Kinrara mosque was called by the Dang Wangi police for statement recording only yesterday afternoon. Why did the police do it so late, one week after I was arrested? Why didn’t they check their facts first before they arrested me and put me behind bars?

I have been made scapegoat in the internal squabbles of Umno.

I see my detention as a ploy by Umno to try to cover up the embarrassment and the outrage of the racist statements made by Ahmad Ismail in Penang. I wonder why did they choose an innocent person like me as I have never made any racist statements or racist speeches in the past?

I lodged a police report on Sept 17 against Utusan Malaysia, Zaini Hassan and Dr Khir Toyo for criminal defamation. I would therefore urge the police to investigate Utusan Malaysia’s editors, those racist bloggers and Dr Khir Toyo under the Penal Code.

As I have mentioned in my previous lawyer’s visit, I will sue Utusan Malaysia, Zaini Hassan and Dr Khir Toyo. I have also instructed my lawyers to sue the Malaysian government for my unlawful arrest and detention.

Raja Petra should be released.

As I am free from ISA detention today, I also call for the release of Raja Petra, the Hindraf Five and all other 60 over detainees under the draconian ISA.

I would also like to thank all politicians in the ruling parties as well as in the Pakatan Rakyat, NGOs, churches and all social organisations who have campaigned and prayed for my release.

The Malaysian Bar Council is holding an EGM today with regards to the recent arrest using ISA.

Of all the 3 arrested on Friday, RPK remains to be freed.

There are 67 people under ISA arrest. There is a person who has been in there for 6 years and 9 months and looks to remain in lockup at least until Jan 2010! Can you imagine being under arrest, in solitary confinement, without a chance to defend yourself for that long?

US STATE DEPARTMENT ON RELEASE OF ALL ISA DETAINEES 19TH. SEPT 2008

"The United States views with grave concern recent use by the Government of Malaysia of the Internal Security Act (ISA) and the possibility that it might be used again to detain opposition political figures. The statement by a government figure that a leading member of the opposition had become "a threat to the economy and national security" is extremely troubling.

The United States firmly believes that national security laws, such as the ISA, must not be used to curtail or inhibit the exercise of universal democratic liberties or the peaceful expression of political views. The detention of opposition leaders under the ISA would be viewed by the United States and the international community as a fundamental infringement of democratic rights and values."
